This Photography Agreement (“Agreement”) is made between Blue Gem Portraits, owned and operated by Zaharra Hemani (“Photographer”), and Client, for a Santa Meet & Greet Session.

1. Session Details
*Session Type: Santa Meet & Greet
*Session Length: 5 minutes
*Location: First United Bank – Craig Ranch
6401 Custer Rd, Suite 100, McKinney, TX 75070
*Session Date:November 24th
*Session Time: Client-selected time between 12:00 PM and 3:00 PM
*Participants:Children and/or family members listed by Client
Client understands that these sessions are strictly 5 minutes, and the photographer must remain on schedule for all booked sessions.

2. Payment
*Payment is due in full at the time of booking.
*Your session is not reserved until full payment has been received.
*All payments are non-transferable.
*Cancellations require 48 hours’ notice to receive a refund.
*If cancellation occurs less than 48 hours before the session, the session may be rescheduled if availability allows, but no refund will be given.
*If the client does not attend their scheduled time, the session is considered a no-show, and no refund or reschedule will be offered.

3. Timeliness
*Client agrees to arrive 10 minutes early to allow time for parking, check-in, and preparation.
*Sessions will begin and end at the scheduled time. Late arrival will result in reduced session time, with no extension or refund.
If the client misses their designated time slot, the session will be forfeited.

4. Photographer’s Artistic Style
*Client acknowledges that Blue Gem Portraits maintains a consistent artistic style. Editing choices, lighting, Santa interactions, and final image selection are solely at the photographer’s discretion. No specific poses or outcomes are guaranteed due to the short session length and child unpredictability.

5. Delivery of Digital Images
* Up to 5 digital images will be delivered via an online gallery within 2 weeks of the session.
* Additional images may be purchased after gallery delivery.
* Galleries remain available for a limited time (usually 14–30 days) unless otherwise stated.

6. Copyright & Print Release
* All images remain the copyright of Blue Gem Portraits.
* Photographer grants Client a limited print release for personal use only.
* Images may not be sold, altered, re-edited, or used commercially without written permission.

7. Model Release
Client grants permission for Blue Gem Portraits and Zaharra Hemani to use images from the session in:
* portfolio displays
* website and social media
* marketing and promotional materials
* printed studio samples
If Client wishes to decline the model release, they must notify the photographer in writing before the session date.

8. Safety & Child Comfort
* Santa Meet & Greet sessions are designed to be warm and magical.
* Photographer and Santa will not force interactions if a child is uncomfortable or fearful.
* A parent or guardian must be present and is responsible for the child’s safety and behavior at all times.

9. Illness Policy
* If anyone in the Client’s household is ill, please do not attend.
* If illness is apparent at the session, service may be refused without refund.
* If the photographer becomes ill or encounters an emergency, the session will be rescheduled or refunded.

10. Limitations Due to Session Length
Because sessions are only 5 minutes:
* Not all poses or combinations may be possible.
* Santa interactions depend on the child’s comfort level.
* Props or setups cannot be customized.
* Re-shoots will not be offered except in cases of technical failure.

11. Liability
Blue Gem Portraits and Santa are not responsible for:
* uncooperative children
* refusal to interact with Santa
* clothing or appearance issues
* accidental injury on premises
Client agrees to hold Blue Gem Portraits harmless from any unexpected outcomes or incidents.

12. Agreement
By booking the session and submitting payment, Client confirms that they have read, understood, and agree to all terms outlined above.
